My hourly v. salaried employee article was recently featured in The National Law Journal, the “Wall Street Journal of the Legal Profession.” I love to contribute to these kinds of publications because I am giving advice to my fellow attorneys on the experiences I’ve had over the past 35+ years.
In the article I also spoke about President Barack Obama’s recent announcement to seek sweeping changes to some of the FLSA exemptions. The memorandum sent by the president to the secretary of labor is ambiguous because it states only that “regulations regarding exemptions from the [FLSA’s] overtime requirement, particularly for executive, administrative and professional employees, have not kept up with our modern economy.” The president asked the secretary to “propose revisions to modernize and streamline the existing overtime regulations.” It will be interesting to see if it is passed in the upcoming months.
